Rules and Regulations

"DISNEY’ MOVIE TIME CONTEST" RULES AND REGULATIONS

"DISNEY’S MOVIE TIME" ("Contest") will be held on STAR Plus ("Channel") as stated hereunder:

1. The Contest will be held on the following days from 17:00:00 hour to 19:00:00 hours each day on the Channel:

The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.

2. On each date mentioned in rule 1 herein above, the Channel shall telecast a Disney Film(s) as per the table below:

3.  The Channel and/or STAR India Private Limited ("STAR India") reserve the right to change the schedule of the Contest including but not limited to telecast of the Disney Film(s), the date of telecast, the time of telecast of the Disney Film(s), the date of telecast of the Disney Film(s). This includes, STAR India and/or the Channels right to replace a particular Disney Film(s) with another Disney film(s). It shall be the sole responsibility of the contestant(s) to check the schedule.

4.  The viewer(s) desirous of participating in the Contest must watch the Disney Film(s).

5.  During each break of each Disney Film(s), a graphic plate of 20 seconds with a voice over shall ask a question, which shall relate to that Disney Film telecast on that day. The question shall be followed by multiple choice answers, one of which shall be the correct answer to that question. For clarification it is expressly stated herein that only one (1) of the said options will be the correct answer to that question(s).

6.  The contestant(s) who is interested in participating and qualifying for the Contest should send in their answers for that Disney Film(s) via SMS to 57827. The SMS should contain the keyword "DMT" followed by followed by the alphabetic answer options (i.e. a or b or c), which the contestant(s) believes is the correct answer to that question(s).

7.  The answer for the question asked for that Disney Film(s) should be sent by the contestant(s) on the same day on which the Disney Film(s) was telecast anytime after the question is asked on that date but before 18:59:59 hours on that date. Answers sent for the question asked on that date after the timeline stated in this rules and regulations shall not be considered and shall be null and void.

8.  The viewers who are subscribers of (i) Vodafone or (ii) Idea or (iii) Reliance Infocomm or (iv) BSNL or (v) MTNL Delhi (prepaid) or (vi) MTNL Mumbai (postpaid) or (vii) or (viii) BPL or (ix) Spice Telecom or (x) Airtel or (xi) Tata Indicom or (xii) Reliance Telecom or (xiii) Aircel can only participate in the Contest.

9.  The cost of the SMS shall be solely borne by the contestant(s). The cost of each SMS shall be charged by the respective mobile operators at rate stated herein below:

Rs. 3: Aircel, Idea, Reliance Infocomm, Spice Telecom, Vodafone, Tata Indicom, Airtel.

Rs. 2: MTNL Delhi (Pre paid), Reliance Telecom, BPL Mobile, BSNL.

Rs. 1: MTNL Mumbai, MTNL Delhi (post paid).

STAR India Private Limited ("STAR India") and/or the Channel and/or Disney ABC International Television. ("Disney") shall not be responsible in the event of any network problem and/or the cost of the SMS charged by the mobile operator. Any dispute in connection to the same should be settled between the subscriber and the mobile operator directly and without involving STAR India and/or the Channel and/or Disney.

10.  Neither STAR India nor the Channel nor Disney shall be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMS charged by the mobile operator. Any dispute in connection to the same shall be settled between the contestant(s) and the mobile operator without involving STAR India or the Channel or Disney.

11.  All the entries should state all the required information, which have been asked from the contestant(s).

12.  STAR India and/or the Channel shall select the Winner(s) in the following manner:

12.1 Hercules	STAR India and/or the Channel will randomly select hundred (100) winners among the contestants who have answered the question correctly during this Disney Film.
12.2 Toy Story	STAR India and/or the Channel will randomly select three hundred (300) winners among the contestants who have answered the question correctly during this Disney Film.
12.3 Cinderella	STAR India and/or the Channel will randomly select two hundred (200) winners among the contestants who have answered the question correctly during this Disney Film.
12.4 Finding Nemo	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
12.5 Jungle Book	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
12.6 Tarzan	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
12.7 Lion King	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
B.	One Grand Winner of each Disney Film the Contest. - Grand Prize Winner(s)
12.8	STAR India and/or the Channel shall randomly select one (1) grand Prize Winner(s) among the contestants who have answered all questions correctly for each of the Disney Film. Thus, during the Contest there shall be total seven (7) Grand Prize Winner.

13. STAR India and/or the Channel reserve the rights to decide the Winner(s) of the Contest.

14. The Winner(s) shall be entitled to the following Prizes:

A.	Winner(s) for Each Disney Film(s)
Disney Film(s).	Prizes	Sponsored By
Hercules	Each Winner(s) as stated in rule 12.1 shall be entitled to three (3) months free subscription to the Disney Magazine.	This Prize shall be sponsored by Disney.
Toy Story	Among the three hundred Winners selected as stated in rule 12.2 herein above, any two hundred Winner(s) shall be entitled to one (1) Disney DVD each.	This Prize shall be sponsored by Disney.
	The remaining hundred (100) Winner(s) selected under rule 12.2 herein above, will be entitled to three (3) months free subscription to the Disney Magazine.	This Prize shall be sponsored by Disney.
Cinderella	Each Winner(s) selected under rule 12.3 shall be entitled to "Disney Princess gift hampers" which will consist of assortment of dolls, play sets and board games.
Finding Nemo	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.	This Prize shall be sponsored by Disney.
Jungle Book	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
Tarzan	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
Lion King	The viewers shall be informed shortly but prior to the date of telecast of that Disney Film. It is the sole responsibility of the viewer to check these rules and regulations to ascertain these details.
B.	Grand Prize Winner(s). - "Grand Prize Winner(s)"

	Each Grand Prize Winner(s) shall be entitled to a trip to Disneyland Park in Hong Kong. The Grand Winner(s) shall be permitted to take three companions i.e. one adult and two children ("Companion"). The Prize shall include the following:
(i)	Four air tickets to travel to Hong Kong and back to Mumbai on economy class. One Air ticket would be for the Winner and three for the Winner's Companion.	The Air tickets would be arranged and sponsored by STAR India Private Limited.
(ii)	One day entrypass for a family of four members to Hong Kong Disneyland Park. Admission to the Park is subject to the rules and regulations of the Park which are set out in the website at www.hongkongdisneyland.com. Viewers must refer to these terms and conditions.	The Entry Pass shall be arranged and sponsored by Disney.
(iii)	Stay for Two (2) nights and Three (3) day on twin/ double sharing basis at a three star hotel for the Winner and the Three Companion. The stay shall also include American Breakfast to be provided in the hotel. The Winner and the Companion would have to share the room.	The Hotel stay shall be arranged and sponsored by Disney.

15.  The Grand Prize does not include the cost charges and expenses in connection to obtaining visas, airline taxes, fees towards Emigration Check Not Required ("ECNR"). Any and all incidental costs direct and/or indirect, in relation to the Prize, including but not limited to visas, airline taxes, fees towards ECNR, any food (including lunch and dinner) and/or laundry and/or travel and/or local transportation and/or air port transfers and/or tours and/or STD/ISD/local calls and/or any other services used by the Winner and/or the Companions in the hotel and during their stay in Hong Kong, shall be solely borne by the Winner and in no manner whatsoever shall STAR India and/or the Channel and/or or Warner, shall be responsible for the same.

16.  STAR India and/or the Channel shall be responsible for only the Air tickets would be arranged and sponsored by STAR India Private Limited as stated in rule 14 herein above. Therefore, save and except for the cost of air-ticket(s) as stated in rule 14, neither the Channel nor STAR India shall be responsible in connection to the Prize. Since the remaining Prizes are sponsored and arranged by Disney, Disney shall be solely responsible for the same. All queries, claims and/or dispute in connection to the other Prize should be settled between the Winner/Companions and Disney, without involving STAR India and/or the Channel.

17.  Subject to rule 18, Disney shall have the sole right to make any decision relating the Prize including but not limited to the hotel in which the accommodation will be given to the Winner and the Companion(s), the mode of transport to the Disneyland Park in Hong Kong. All decisions made by Disney in connection to the aforesaid shall be final and binding on the Winner and the Companions.

18.  STAR India shall have the sole right to make any decision regarding the airlines that the Winner and the Companion(s) would take to travel to Hong Kong. In the event, the airlines in which the Winner and the Companion are booked on, is cancelled and/or delayed, neither the Winner nor the Companion shall have the right to claim any damages or any kind of monies from STAR India and/or the Channel and/or Disney.

19.  The Grand Prize(s) is non-transferable and is not redeemable for cash equivalent or any other items. The Grand Prize(s) has to be redeem used by the Winner(s) and is valid only upto 31st March 2008, excluding the following block out dates:

December 21, 2007 - January 1, 2008

February 6, 2008 - February 17, 2008

March 21, 2008 - March 24, 2008

Grand Prize(s) not redeem during the validity period will be forfeited.

20.  Once all the bookings are made, the Winner shall not be able to make any changes including changing the name of the Companion(s).

21.  The Grand Prize Winner(s) and the Companions should have a valid passport and that the passport should not expire within the next six (6) months from the date of travel.

22.  The Grand Prize Winner(s) and the Companion shall not be permitted to stay longer in the hotel beyond the stay reserved by Disney and/or change the airlines. In the event, the Grand Prize Winner(s) and/or the Companion(s) decides to deviate from the Prize, the Grand Prize Winner(s) would have to bear all such costs, charges, risks and expenses thereof.

23.  The Companion shall always travel with the Grand Prize Winner(s) and if the Grand Prize Winner(s) cannot travel to any place or do certain activities then the Companion(s) shall also be restricted from traveling and/or doing those activities. The Grand Prize Winner(s) shall be solely responsible to take care of the Companions and/or the acts of the Companions, and shall always, indemnify and keep indemnified STAR India and/or the Channel and/or Disney against any third party claims for the acts of the Companions.

24.  In the event, the Grand Prize Winner(s)/Companion wishes to cancel the air tickets or bookings made in the hotel or any activities pre-decided by Disney and/or STAR India, all the cost(s), charges and expenses for cancellation shall be borne by the Winner(s).

25.  The Grand Prize Winner(s) and the Companions shall be solely responsible to obtain all approvals from local and/or government authorities to travel to Hong Kong including but not limited to obtaining valid passport, visa to Hong Kong, Emigration Check Not Required ("ECNR") etc. Neither STAR India nor Disney nor the Channel shall be responsible to obtain any approvals. In the event, the Disney and the Companions fail to obtain any approvals including but not limited to a visa and/or ECNR or is unable to travel for any other reason whatsoever, the Winner right to the Prize shall be forfeited and STAR India and/or the Channel and/or Disney shall be released from all obligations towards the Winner in connection to the Grand Prize Winner(s).

26.  All the Winners shall be informed/contacted by STAR India or the Channel or Disney.

27.  By participating in the Contest, it shall be construed that the contestant(s), the Winner(s) and the Companions of the Grand Prize Winner(s) have waived their right to raise any dispute with regard to the Prize and/or in any manner whatsoever in connection to the Prize.

28.  Neither STAR India nor the Channel nor Warner nor its employees have given a guarantee and/or warranty etc. regarding the services to be offered by the hotels, airlines etc. and that neither STAR India nor the Channel nor Disney nor its employees shall be responsible for any reason whatsoever in connection thereto.

29.  STAR India and/or the Channel and/or Disney may in its sole discretion exclude the Grand Prize Winner(s) and/or the Companion from traveling if (i) STAR India and/or the Channel and/or Disney is of the opinion that the Grand Prize Winner(s) and/or the Companions is unfit to travel, (ii) circumstances which, in the STAR India and/or the Channel and/or Disney 's opinion, renders the contestant unfit to participate; (iii) inability of the Winner(s) and/or the Companion to produce documentation required by STAR India and/or Channel and/or Disney in the rules and/or at any given point of the time.

30.  STAR India and/or Channel and/or Disney may forfeit the Prize and refuse the Grand Prize Winner(s) and/or the Companion from traveling in the event of the Grand Prize Winner(s) or the Companion commits fraud or is dishonest etc.

31.  STAR India and/or the Channel and/or Disney reserves the right to prevent the Grand Prize Winner(s) and/or the Companions from traveling if any of them is suffering from any kind of ill health, medical problems (viz.: heart problem, blood pressure problem, pregnancy, etc.). It is the responsibility of the Grand Prize Winner(s) and the Companions to be medically fit and a copy of such an medical certificate must be submitted with STAR India and/or the Channel and/or Disney.

32.  The Grand Prize Winner(s) and the Companions shall abide to all the laws including Immigration Laws, Foreign Exchange Regulations applicable in India and/or Hong Kong and/or any country. Neither STAR India nor the Channel nor Disney will be liable for non-compliance of any laws by the Grand Prize Winner(s) or the Companions in India and or aboard and the Grand Prize Winner(s) shall indemnify and hold harmless STAR India and/or the Channel and/or the Disney in relation to any non-compliance by the Grand Prize Winner(s) and/or the Companions.

33.  The decision of STAR India and/or the Channel and/or Disney shall be final and binding on all the contestant(s) and by participating in the Contest, it shall be construed that the contestant(s) has waived his/her right to raise any dispute against any decision made by STAR India and/or the Channel and/or Disney.

General Rules

1. The contestants should be citizens of India, residing in India and above 18 years of age to qualify for the Contest. The contestants should not have criminal conviction.

2. Neither the contestant nor the Winner nor the Companion should not have criminal conviction or should not be bound by any contract or agreement that would not permit the contestant from participating in the Contest.

3. The contestants whose name the mobile number is registered with a network operator shall be eligible to participate in the Contest. Consequently, the Winner whose name the mobile number is registered with a network operator shall be entitled to the Prize.

4. The Winner must submit with STAR India and/or the Channel a copy of the last two bills issued by the network operator as a proof that the mobile number is registered in the name of the Winner and such other documents that could be furnished as proof that the mobile number is registered in the Winner name.

5. Proof of age is a must for the contestant and must be submitted to the Channel/ STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

6. Channel and/or STAR India reserve all rights to make amendments to the existing rules without prior notice or withdraw the Contest without prior notice for any reason whatsoever.

7. Non-conformance by any contestant and/or the Winner or the Companion, of the rules of the Contest will disqualify the contestant and/or the Winner and/or the Companion from participation or winning, immediately, as the case may be.

8. The Grand Prize Winner(s) shall be solely responsible for the Companion and shall liable for all the acts of the Companions. STAR India or the Channel or Disney reserve the rights to take an action against the Grand Prize Winner(s) for any wrongful acts, actions etc. committed by the Companion(s) during the trip or in connection to the Prize. STAR India or the Channel or Disney may take such civil and/or criminal action as it may deem fit either against the Winner or the Companion or against both for the aforesaid.

9. The Winner(s) shall be responsible to collect the Prize from Disney. The contestant(s) agree that the Prize cannot be exchanged with other items and/or exchanged for cash equivalent. The Winner further agrees that the Winner shall not dispute the value of the Prize so offered to the Winner upon the Winner winning the Contest. If the Winner refuses to accept the Prize offered or fails to collect the Prize, neither Channel nor STAR India nor Disney shall be responsible for the same and Channel and STAR India and Disney, all shall be released from any and all obligations towards the Winner or the Companion in connection to the Prize won by the Winner. In such an event, STAR India or the Channel or and Disney shall have the right to declare another person as the Winner of the Contest and transfer the Prize to that person.

10. All the Winner(s) including the Grand Prize Winner(s) of the Contest and the Companion agree that he/she shall make himself/herself available from time to time and co-operate with Channel and/or STAR India and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to the Winner. Further, all the Winner(s) including the Grand Prize Winner(s) of the Contest and the Companion shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. All the Winner(s) including the Grand Prize Winner(s) of the Contest and the Companion agree that the footage of any nature with regard to the them shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

11. By participating in the Contest, it shall be construed that the all the Winner(s) including the Grand Prize Winner(s) of the Contest and the Companion have undertaken to hold harmless Channel, STAR India, Disney its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her while participating in the Contest, or while traveling to Hong Kong, while sigh seeing, while carrying out activities or for any reason whatsoever in connection with the Prize.

12. Further, participation of the contestants in the Contest shall be construed that the contestant(s) has waived her/his right to file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum against the Channel, STAR India or Disney to claim any damages or reliefs or otherwise.

13. The Winner agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or STAR India and/or Disney, the Prize and/or anything relating to the Prize and/or the enjoyment of the Prize and/or anything included the Prize becomes ineffective or invalid, neither the Channel nor STAR India nor Disney shall be held responsible for the same.

13. Neither the Channel nor STAR India nor Disney is in any manner whatsoever responsible and/or liable in any manner whatsoever, for any physical injury, death, mental trauma caused to the any of the Winner(s) or Companion of the Grand Prize Winner(s) or any person related to them, in any manner whatsoever, including but not limited to in relation to the Contest and/or Prize.

14. Employees of the Channel, STAR India and Disney and the members of their immediate family or any persons with criminal convictions or persons other than citizens of India, are ineligible to participate in the Contest.

15. Any and all taxes and/or levies applicable under the laws of India or Hong Kong shall be borne by the Winner in relation to the Prize.

16. All contestant(s), the Winner and the Companion shall do any and all acts and execute any and all documents in such manner and at such location as may be required by Channel and/or STAR India and/or Disney in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India and/or Channel and/or Disney herein.

17. All contestants agree to abide by the rules including the general rules.

18. Participation of the contestant in the Contest shall be construed that the contestant(s), the Winner and the Companion have waived his/her right to dispute any decision(s) made by the Channel or STAR India or Warner in connection to the Contest and that the contestant(s) agrees to all the decision(s) made by the Channel or STAR India or Warner and that all the decision(s) shall be final and binding upon the contestant(s) and the Companion.

19. The Winner and/or the Companion is required to pay the tax deductible at source under the Income Tax Act, 1961 and/or under the laws of India in relation to the Prize and furnish a copy of the receipt (challan) in relation to the tax deductible at source paid by the Winner and/or the Companion.

20. The Channel and/or STAR India reserve the right to forfeit the Prize in the event it is found by the Channel or STAR India or Warner that any information provided by the contestant(s) or the Winner or the Companion is wrong or any misrepresentation is made by the contestant(s) or the Winner or the Companion. STAR India or the Channel shall have the right to declare another person as the winner of the Contest and transfer the Prize to that person.

21. The participation of the contestant(s) in the Contest shall mean that the contestant(s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest and also explained to rules to the Companion.

22. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the contestant(s) who has raised the dispute.

23. Subject to rule 22, the courts of Mumbai have sole and exclusive jurisdiction.
