The "CLINIC ALL CLEAR JO JEETA WOHI SUPERSTAR" Show Rules and Regulations:

1. This "CLINIC ALL CLEAR JO JEETA WOHI SUPERSTAR" rules and regulations are for the participants, participating in the program titled "Clinic All Clear Jo Jeeta Wohi Superstar" ("Program") to be held on STAR PLUS ("Channel") commencing from April 11, 2008 to July 12, 2008 ("Period").

2. It is a biweekly Program, which will be telecast every Friday and Saturday during the Period at the timings stated below:

(i) Every Friday and Saturday for the first nine (9) weeks during the Period - from 10:00 p. m to 11.30 p.m.
(ii) Every Friday and Saturday for Week 10, 11 and 12 during the Period - from 10:00 p. m to 11.30 p.m.
(iii) Every Friday and Saturday for Week 13 during the Period - from 10:00 p. m to 11.00 p.m.
(iv) On Friday of the last week (Week 14) - from 10:00 p. m to 11.00 p.m.
(v) On Saturday of the last week (Week 14) - from 8:00 p. m to 12.00 p.m.

3. There are six (6) champions who were the winners of singing talent hunt shows i.e., Indian Idol, Zee Sa Re Ga Ma Pa, Voice of India, Sa Re Ga Ma Pa Ek Main Aur Ek Tu, Fame Gurukul ("Champions") and twelve (12) challengers who were the runner's up and/or the most acclaimed participant(s) of singing talent hunt shows i.e., Indian Idol, Zee Sa Re Ga Ma Pa, Voice of India, Sa Re Ga Ma Pa Ek Main Aur Ek Tu, Fame Gurukul ("Challengers") who will be participating and competing in the Program.

Selection Procedure for Week 1 to Week 3

4. During the Period, the Challengers will give their best singing performance ("Performance") in the Program and the judges of the Program will judge their Performance. Each Challenger will get points from the judges of the Program, on the basis of his/her Performance on that particular day during the Period.

5. Based on the points gained by each Challenger, three (3) Challenger(s) who have gained highest score on the basis of points given by the judges of the Program will be short-listed ("Short-listed Challengers").

6. Out of the Short-listed Challengers, one (1) Short - Listed Challenger will be thereafter selected on the basis of the individual votes cast by the Champions of the Program for their favorite Short-listed Challengers ("Selected Champion").

7. In case of a tie in choosing the Selected Champion, the remaining Challengers will vote for the Short - Listed Challengers and thereafter on basis of the votes cast by the Challengers, the Selected Champion will be declared.

8. All the Champions, i.e., the original six (6) Champions and the Selected Champion shall give their best Performance(s) during the Program.

9. Each Champion and the Selected Champion will get points from the judges of the Program and the viewers through voting poll on the basis of his/her Performance. The Champion and/or the Selected Champion who has scored minimum points will be eliminated on Friday of the next week of the Program.

10. The same procedure as mentioned in rule 4 to rule 9 above shall be followed until week 3 of the Program or until nine (9) Challengers remain, whichever is later. The remaining Challengers shall give their Performance(s) in the next week during the Period.

Selection Procedure for Week 4 and Week 5

11. The remaining Challengers will give their Performance(s) in the Program and the judges of the Program will judge such Performance(s) and will be given points on the basis of their Performance(s) on that particular day.

12. Based on the points gained by each remaining Challenger, three (3) Challenger(s) who has gained highest score on the basis of points given by the judges of the Program will be short-listed ("Short-listed Challengers"). Out of the Short-listed Challengers, one (1) Short - Listed Challenger will be thereafter selected on the basis of the individual votes cast by the Champions of the Program for their favorite Short-listed Challengers ("Selected Champion"). The Selected Champion and the Challenger who has gained the lowest score will be eliminated on in the same episode on Friday. They will not be eligible to participate in the further rounds of the Program.

13. All the six (6) Champions and the Selected Champion shall give their best Performance(s) during the Program.

14. Each Champion and the Selected Champion will get points from the judges of the Program and the viewers through voting poll on the basis of his/her Performance. The Champion and/or the Selected Champion who has scored minimum points will be eliminated on Friday of the next week of the Program.

15. The same procedure as mentioned in rule 11 to rule 14 above shall be followed until week 5 of the Program or until five (5) Challengers remain, whichever is later. The remaining Challengers shall give their Performance(s) in the next week during the Period.

Selection Procedure for Week 6

16. Two (2) new participants will be introduced in Week 6 of the Program ("Challengers' Wild Card Episode"), who will neither be the Champions nor the Challengers of this Program ("Wild Card Entries"). These Wild Card Entries will either be the winner or runner- ups of the singing talent hunt shows.

17. The Wild Card Entries and the remaining Challengers (hereinafter collectively referred to as the "Wild Card Challengers") will give their Performance(s) in the Challengers' Wild Card Episode of the Program. The judges of the Program will judge such Performance(s) and give points on the basis of their Performance(s) during the Wild Card Episode of the Program.

18. Based on the points gained by the Wild Card Challengers, three (3) Wild Card Challenger(s) who has gained highest score on the basis of points given by the judges of the Program will be the short-listed ("Short-listed Challengers"). Out of the Short-listed Challengers, one (1) Short - Listed Challenger will be thereafter selected on the basis of the individual votes cast by the Champions of the Program for their favorite Short-listed Challengers ("Selected Champion"). The Selected Champion and the Wild Card Challenger who has gained the lowest score will be eliminated on Saturday of the next week of the Program.

19. The Selected Champion as stated in rule 16 above may either be a Wild Card Entry or the Challenger.

20. All the six (6) Champions and the Selected Champion shall give their best Performance(s) during the Program.

21. Each Champion and the Selected Champion will get points from the judges of the Program and the viewers through voting poll on the basis of his/her Performance(s). The Champion and/or the Selected Champion who has scored minimum points will be eliminated on Friday of the next week of the Program and will not be entitled to participate in the further rounds of the Program.

Selection Procedure for Week 7

22. The remaining five (5) Challengers will give their Performance(s) in the Program and the judges of the Program will judge such Performance(s) and will be given points on the basis of their Performance(s) on that particular day.

23. Based on the points gained by each remaining Challenger, one (1) Challenger who has gained highest score on the basis of points given by the judges of the Program will be the Selected Champion and the Challenger who has gained the lowest score will be eliminated on in the same episode on Friday.

24. All the six (6) Champions and the Selected Champion shall give their best Performance(s) during the Program.

25. Each Champion and the Selected Champion will get points from the judges of the Program and the viewers through voting poll on the basis of his/her Performance. The Champion and/or the Selected Champion who has scored minimum points will be eliminated on Friday of the next week of the Program and will not be entitled to participate in the further rounds of the Program.

Selection Procedure for Week 8

26. Thereafter, during Week 8 of the Program, the remaining three (3) Challengers will give their Performance(s) in the Program and the judges of the Program will judge such Performance(s) and will be given points on the basis of their Performance(s) on that particular day.

27. In the same episode five (5) Champions who were eliminated in the earlier rounds of the Program will be introduced as wild card entries ("Ex -Champions") and will give their Performance(s) in the Program and the judges of the Program will judge such Performance(s) and will be given points on the basis of their Performance(s) on that particular day.

28. Based on the points gained by each of the three (3) Challengers and five (5) Ex-Champions, three (3) Challengers and/or Ex-Champions will be short listed ("Short-listed Champions")

29. Out of the Short-listed Champions, two (2) will be thereafter selected on the basis of the individual votes cast by the Champions of the Program for their favorite Short-listed Champion ("Additional Champions").

30. The Champions and the Additional Champions will give individual (solo) Performance on Saturday. Such Performance will be judged by the judges of the Program and will also give points to their Performance(s). The Champions and Additional Champions will be hereinafter collectively referred to as the "Finalists".

31. The points gained by each Finalist on Saturday will be carried forward to the next Week.

Selection Procedure for Week 9

32. During Week 9 of the Program, eight (8) Finalists will give their individual (solo) Performance on Friday and the judges of the Program will judge their Performance(s) and will give points to their Performance(s). The points earned by the Finalist(s) on Friday will carry 25% weightage to total score gained by that Finalist.

33. The Finalist(s), who has given his individual (solo) Performance on Friday, shall give a duet Performance with a celebrity playback singer on Saturday. Such Performance will be judged by the judges and celebrity playback singer(s) of the Program and will also give points to their Performance(s). The points earned by the Finalist(s) on Saturday will carry 25% weightage to the total score gained by that Finalist(s).

34. The remaining 50% weightage will be calculated on the total number of votes received from the viewers of the Program for that particular Finalist(s) for his/her Performance in that week through separate polling/voting activity.

35. There will be no elimination in this Week. However, the points gained by each Finalist will be carried forward to the next Week

Selection Procedure for Week 10

36. Based on the total points (i.e, judges points and votes) gained by each Finalist on Saturday of Week 8 and Friday and Saturday of Week 9, one (1) Finalist who has gained the lowest score will be eliminated on Friday of this Week.

37. During this Week of the Program, the remaining seven (7) Finalists will give their individual (solo) Performance on Friday and the judges of the Program will judge their Performance(s) and will give points to their Performance(s). The points earned by the Finalist(s) on Friday will carry 25% weightage to total score gained by that Finalist.

38. .The Finalist(s), who has given his individual (solo) Performance on Friday, shall give a duet Performance with a celebrity playback singer on Saturday. Such Performance will be judged by the judges and celebrity playback singer(s) of the Program and will also give points to their Performance(s). The points earned by the Finalist(s) on Saturday will carry 25% weightage to the total score gained by that Finalist(s).

39. The remaining 50% weightage will be calculated on the total number of votes received from the viewers of the Program for that particular Finalist(s) for his/her Performance in that week through separate polling/voting activity.

Selection Procedure for Week 11

40. Based on the points gained by the Finalists on basis of their performances given on Friday and Saturday of the preceding Week, one (1) Finalist who has gained the lowest score will be eliminated from the Program on Friday of this Week. and will not be eligible to participate in the further rounds of the Program.

41. During this Week of the Program, the remaining six (6) Finalists will give their individual (solo) Performance on Friday and the judges of the Program will judge their Performance(s) and will give points to their Performance(s). The points earned by the Finalist(s) on Friday will carry 25% weightage to total score gained by that Finalist.

42. The Finalist(s), who has given his individual (solo) Performance on Friday, shall give a duet Performance with a celebrity playback singer on Saturday. Such Performance will be judged by the judges and celebrity playback singer(s) of the Program and will also give points to their Performance(s). The points earned by the Finalist(s) on Saturday will carry 25% weightage to the total score gained by that Finalist(s).

43. The remaining 50% weightage will be calculated on the total number of votes received from the viewers of the Program for that particular Finalist(s) for his/her Performance in that week through separate polling/voting activity.

Selection Procedure for Week 12

44. Based on the points gained by the Finalists on basis of their performances given on Friday and Saturday of the preceding Week, one (1) Finalist who has gained the lowest score will be eliminated from the Program on Friday of this Week and will not be eligible to participate in the further rounds of the Program.

45. During this Week of the Program, the remaining six (6) Finalists will give their individual (solo) Performance on Friday and the judges of the Program will judge their Performance(s) and will give points to their Performance(s). The points earned by the Finalist(s) on Friday will carry 25% weightage to total score gained by that Finalist.

46. The Finalist(s), who has given his individual (solo) Performance on Friday, shall once again give individual (solo) Performance on Saturday. Such Performance will be judged by the judges of the Program and will also give points to their Performance(s). The points earned by the Finalist(s) on Saturday will carry 25% weightage to the total score gained by that Finalist(s).

47. The remaining 50% weightage will be calculated on the total number of votes received from the viewers of the Program for that particular Finalist(s) for his/her Performance in that week through separate polling/voting activity.

Selection Procedure for Week 13

48. Based on the points gained by the Finalists on basis of their performances given on Friday and Saturday of the preceding Week, two (2) Finalists who have gained the lowest score will be eliminated from the Program on Friday of this Week and will not be eligible to participate in the further rounds of the Program.

49. During this Week, remaining three (3) Finalists will give their individual (solo) Performance on Friday and Saturday and the judges of the Program will judge their Performance(s) and will only give opinion about their Performance(s) and no points will be given in this episode. The viewers will vote for their favorite Finalist(s) based on their Performances through a separate polling/voting activity.

Selection Procedure for Week 14

50. During this Week, the three (3) Finalists will perform two (2) songs each on Friday and on the basis of their Performances the viewers will vote for their favorite Finalist(s) through a separate polling/voting activity.

51. Thereafter, on Saturday, the three (3) Finalist(s) will compete with each other during an on ground activity ("Grand Finale") of the Program and the viewers will also vote for their favorite Finalist(s) based on their Performances through a separate polling/voting activity.

52. The Finalist, who has earned maximum amount of cumulative score calculated on the basis of points earned as per rule 49, 50 and rule 51 will be declared as the winner of the Program ("Superstar").

PART "A" - RULES

53. The Superstar will receive a cheque of Rs. 50,00,000/- (rupees fifty lakhs only) ("Prize") which will be issued in the name of the Superstar only within fifteen (15) days of the telecast of the grand finale episode of the Program in the last week.

54. STAR India Private Limited ("STAR India") and/or the Channel reserves the right to decide the Challenger(s) and/or Champion(s), Selected Champion(s), Wild Card Challenger, Finalist(s), and/or Superstar of the Program and such decision shall be final and binding on the Challenger(s) and/or Champion(s), Selected Champion(s), Wild Card Challenger, Wild Card Entries, Finalist(s), and/or Superstar of the Program.

55. The set of the Program is in Mumbai. Therefore, in the event, the Challenger and/or the Champion resides outside Mumbai, they would have to travel to Mumbai.

56. STAR India and/or the Channel shall have the sole right to decide the dates to visit the set of the Program stated in rule 55 herein above.

57. In the event, the Champion(s) and/or the Challenger(s) and/or Wild Card Entries reside outside Mumbai; the Champion(s) and/or the Challenger(s) shall also be eligible to the following:

57.1 One economy class air ticket to Mumbai and back to the city in which the Champion(s) and/or the Challenger(s) and/or Wild Card Entries resides. STAR India shall solely have the right to decide the airline that the Champion(s) and/or the Challenger(s) shall travel and this decision of STAR India shall be final and binding on the Champion(s) and/or the Challenger(s).

57.2 Stay in an apartment located in Mumbai in any area and for the period that may be decided by STAR India. The Champion(s) and/or the Challenger(s) will also be provided breakfast, lunch and dinner during their stay in Mumbai. The apartment would be chosen by STAR India and the decision of STAR India in this regard shall be final and binding, the cost of which shall be borne by STAR India.

58. In the event, the Champion(s) and/or the Challenger(s) and/or Wild Card Entries cannot travel and visit the set of the Program on the date on which STAR India has decided for the Performance, STAR India shall be entitled to announce somebody else as the Champion(s) and/or the Challenger(s) and/or Wild Card Entries of the Program.

59. Save and except as stated in rule 57 herein above, all and any incidental costs (direct and/or indirect), in relation to the Champion(s) and/or the Challenger(s) and/or Wild Card Entries travel and/or stay in Mumbai, including but not limited to any other services used by the Champion(s) and/or the Challenger(s), and/or Wild Card Entries (as the case may be) in the apartment and also during their travel in and to Mumbai, shall be borne by the Champion(s) and/or the Challenger(s) and/or Wild Card Entries and in no manner whatsoever shall the STAR India be held responsible for the same.

60. Neither the Champion(s) nor the Challenger(s) and/or Wild Card Entries shall be allowed to stay longer in the apartment beyond the period as may be decided by STAR India and/or change the airline. In the event, the Champion(s) and/or the Challenger(s) and/or Wild Card Entries decides to deviate from the facilities provided by STAR India, as more particularly stated in rule 57 above, the Champion(s) and/or the Challenger(s) and/or Wild Card Entries would have to bear all such costs, charges, risks and expenses in connection thereof.

61. Neither STAR India nor the Channel nor its employees have given a guarantee and/or warranty etc. regarding the services to be offered by the hotels, airlines etc. and neither STAR India nor the Channel(s) nor its employees shall be responsible for any reason whatsoever in connection thereto.

62. The Champion(s) and/or the Challenger(s) and/or Wild Card Entries shall not raise any dispute with regard to the Program including but not limited to the selection procedure of the Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries Finalist(s), Superstar, etc.

63. STAR India and/or the Channel reserve the right to at any time to withdraw the Program, change the telecast schedule of the Program, amend the rules and regulations of the Program, etc. without giving any prior notice thereof.

PART - B GENERAL RULES

1. The Champion(s) and/or the Challenger(s), and/or Wild Card Entries should be citizens of India, and must be above 18 years of age to qualify for the Program.

2. The Champion(s) and/or the Challenger(s), and/or Wild Card Entries should not have any criminal conviction.

3. Proof of age is a must for the Champion(s) and/or the Challenger(s) and/or Wild Card Entries and must be submitted to the Channel/ STAR India (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

4. The Superstar agrees that he/she shall provide a copy of the Pancard to STAR India whenever required.

5. The Challengers and/or the Champions and/or Wild Card Entries shall not under any contract express, implied or otherwise be barred or restrained from participating in the Program for any reason whatsoever.

6. STAR India and/or the Channel reserve all rights to make amendments to the existing rules without prior notice.

7. Non-conformance by any Champion(s) and/or the Challenger(s), and/or Wild Card Entries and/or the Superstar of the rules of the Program will disqualify the Champion(s) and/or the Challenger(s) and/or Wild Card Entries and/or the Superstar from participation or winnings, immediately, as the case may be.

8. STAR India may in its sole discretion exclude a Champion(s) and/or the Challenger(s) and/or Wild Card Entries from participation in the Program which may include without limitation (i) circumstances which, in STAR India's view, renders the Champion(s) and/or the Challenger(s) and/or Wild Card Entries unfit to participate therein; (ii) inability to produce documentation required by STAR India and/or the Channel in the rules and/or at any given point of the time.

9. STAR India reserves the right to cancel the entry of the Champion(s) and/or the Challenger(s) and/or Wild Card Entries for any reason whatsoever. For avoidance of doubt, the disqualified Champion(s) and/or the Challenger(s) and/or Wild Card Entries agrees that all the intellectual property rights in and to the Program shall continue to vest with STAR India for worldwide and in perpetuity, without any consideration payable to the disqualified Champion(s) and/or the Challenger(s) and/or Wild Card Entries.

10. The Champion(s) and/or the Challenger(s) and/or Wild Card Entries own or have the necessary licenses, rights, consents, and permissions to use and authorize STAR India and/or the Channel to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Performance to enable inclusion and use of the Performance in the manner stated in these rules and regulations.

11. STAR India and/or the Channel may refuse the Champion(s) and/or the Challenger(s) and/or Wild Card Entries from participating in the Program in the event of his fraud, dishonesty or non-entitlement to participate in the Program under this rules and regulations.

12. All Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries Finalist(s), the Superstar of the Program agrees that he shall make himself available from time to time and co-operate with the Channel and/or STAR India and participate in any activity and/or campaign ("Promotional Activity") of any nature whatsoever without any money payable to them. Further, neither the Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s), nor the Superstar shall at any point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s), and/or the Superstar agrees that the footage of any nature with regard to the Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s), and/or the Superstar shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

13. The Superstar agrees that he/she shall not hold STAR India and/or Channel and/or its employees, responsible for delays in delivery of the Prize or damage, loss during transit or any problem in connection to the Prize. The Superstar agrees that the Prize i.e., the cheque will be issued in favor of the Superstar only and in no one else's name. The Superstar agrees that the Prize cannot be exchanged with other items whatsoever. The Superstar further agrees that he shall not dispute the value of the Prize so offered to the Superstar upon the Superstar winning the Program. If the Superstar refuse to accept the Prize offered, the Channel and/or STAR India shall be released from all obligations towards the Superstar in connection to the Prize won by the Superstar.

14. STAR India and/or the Channel shall have irrevocably rights to the Program and/or participation of the Champion(s) and/or the Challenger(s) and/or Wild Card Entries including all the activities of the Champion(s) and/or the Challenger(s) during their participation in the Program including but not limited to the Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s) and/or Superstar's visit to the sets etc., being filmed and/or recorded and/or broadcast on the Channel or any other channel that STAR India and/or any other channel, which STAR India and/or the Channel may deem fit. Further, the Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s) and Superstar shall permit STAR India and/or Channel to use of the Champion(s)'s and/or the Challenger(s)'s, Selected Champion(s)'s, Wild Card Challenger's, and/or Wild Card Entries, Finalist(s)'s and Superstar's name, likeness and private life to be included in the subject matter of the Program and any related publicity, advertising, magazine material and/or otherwise. Further STAR India and/or Channel shall have full right to the footage of any nature in relation to this Program and all such rights shall at all times vest with STAR India, including but not limited to all intellectual property rights, copyrights and any other rights, in any and all media, worldwide and in perpetuity. It can be arranged, re-arranged, added to other material without any payments to Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s) and Superstar.

15. Notwithstanding a Champion(s) and/or the Challenger(s) and/or Wild Card Entries participation in the Program there is no obligation on the part of STAR India and/or the Channel to broadcast the Program in which he has taken part, or any or all of his contribution as recorded by STAR India.

16. The Champion(s) and/or the Challenger(s), Selected Champion(s), Wild Card Challenger, and/or Wild Card Entries, Finalist(s) and/or the Superstar of the Program agrees that he shall hold harmless the Channel, STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him, in any manner, whatsoever in connection with the Program and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or STAR India to claim any damages or relief's or otherwise.

17. The Superstar agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or STAR India, the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, neither the Channel nor STAR India shall be responsible for the same.

18. The Champion(s) and/or the Challenger(s) and/or Wild Card Entries shall during their stay in the apartment as stated in rule 57.2 above behave in a responsible manner and shall not in any manner whatsoever cause any harm, injury, damage, disturbance, inconvenience, disturbance to the residents of the society in which the apartment is provided to them and/or to the residents in the vicinity.

19. In the event, the Champion(s) and/or the Challenger(s) and/or Wild Card Entries fail to observe and abide by the terms of rule 18 above and/or any harm, injury, damage, disturbance, inconvenience, disturbance is caused to the residents of the society in which the apartment is provided to them and/or to the residents in the vicinity, then in such a case the Challenger(s) and/or the Champion(s) and/or Wild Card Entries has agreed that they shall indemnify and hold harmless the Channel, STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss/inconvenience suffered by the residents of the society and/or the vicinity, in any manner, whatsoever.

20. The Channel and/or STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Superstar or any person in connection to the Superstar in any manner whatsoever, including but not limited to the Program and/or Prize.

21. The Champion(s) and/or the Challenger(s) including the Superstar shall abide to the laws of India including Income Tax Act, 1961. STAR India and/or the Channel will not be liable for non-compliance of any laws by the Champion(s) and/or the Challenger(s) and/or the Superstar in India and the Champion(s) and/or the Challenger(s) and/or the Superstar shall indemnify and hold harmless the Channel and/or STAR India in relation thereto.

22. Participation of the Champion(s) and/or the Challenger(s) and/or Wild Card Entries in the Program shall be construed that the Champion(s) and/or the Challenger(s) and/or Wild Card Entries has waived their rights to dispute any decision(s) made by STAR India and/or the Channel in connection to the Program and that the Champion(s) and/or the Challenger(s) and/or Wild Card Entries agrees to all the decision(s) made by STAR India and/or the Channel and that all the decision shall be final and binding upon the Champion(s) and/or the Challenger(s) and/or Wild Card Entries. No correspondence in this regard shall be entertained.

23. By participating in the Program, it shall be construed that the Champion(s) and/or the Challenger(s) and/or Wild Card Entries and/or the Superstar has agreed that the Champion(s) and/or the Challenger(s) and/or the Superstar and/or Wild Card Entries shall indemnify and hold harmless the Channel, STAR India, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by the Champion(s) and/or the Challenger(s) and/or the Superstar, in any manner, whatsoever in connection with the Program and that the Champion(s) and/or the Challenger(s) and/or the Superstar and/or Wild Card Entries has waived all rights to file in person or through any family member or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or STAR India to claim any damages or relief's or otherwise.

24. The Champion(s) and/or the Challenger(s) and/or Wild Card Entries agree to defend, indemnify and hold harmless STAR India and/or the Channel,, its affiliates and their respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) Champion(s) and/or the Challenger(s) and/or Wild Card Entries participation in the Program; (ii) Champion(s) and/or the Challenger(s) violation of any term of this rules and regulations (iii) Champion(s) and/or the Challenger(s) and/or Wild Card Entries violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that any of Champion(s) and/or the Challenger(s) and/or Wild Card Entries participation caused damage to a third party. This defense and indemnification obligation will survive this rules and regulations.

25. All Champion(s) and/or the Challenger(s) and/or Wild Card Entries and the Superstar, shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India and/or the Channel herein.

26. Neither STAR India nor the Channel shall be responsible to pay for any taxes, custom duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the Prize and the same shall be solely borne by the Superstar. A copy of the receipt (challan) confirming the payment of such taxes, charges, license fees and/or levies thereto shall be furnished by the Superstar to STAR India.

27. The participation of the Champion(s) and/or the Challenger(s) and/or Wild Card Entries in the Program shall mean that the Champion(s) and/or the Challenger(s) and/or Wild Card Entries has read, understood, accepted and agreed to abide with all the rules including the general rules of the Program.

28. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Program shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the Champion(s) and/or the Challenger(s) who has raised the dispute.
29. Subject to rule 28, only the courts in Mumbai shall have the sole and exclusive jurisdiction to decide on any dispute relating to the rules and regulations.
